DOES A LANDLORD HAVE THE RIGHT TO MAKE TENANTS GET RID OF THEIR DOGS IN WEST VIRGINIA, NO LEASE FOR 5 YEARS?

I hav not sealed a franchise for 5 years, people in a area have had their dogs for 10 years. Can a property owner legally have them get absolved of their dogs!

    Since you are now considered a month to month tenant…the landlord can change any rules with 30 days notice. Next time make sure you have a lease in place that allows dogs.

    You’d be smart to contact a tenant advocacy group or a lawyer for help with this…if the dog was there before this “rule” and the lease allows dogs, I’d say you have a great than average chance of winning, should it go to court. Even though you haven’t signed a lease in 5 years, your lease would (in my state) still be intact, as it would be considered a month-to-month lease after the expiration date (usually a year) with the same contractual agreement.

    Id check with a lawyer, or contact housing authority.
    If he knew you had the pets, and you’ve had them all this time, I dont think he can make you get rid of them.. he can make a rule that you’re not allowed to get any new pets tho.

    A landlord can change the rules as he sees fit. He must give you reasonable time to comply, usually 30 days. But if you do not have a lease at all, he can kick you out with a 30 days notice.

    The owner of the home can decide whatever they wish. No lease = ability to say “get rid of the dog or get out of my property”.
    You may wish to ask this in the Legal section.

    I would hop on the phone and call your local housing department. It sounds like you’re being screwed. If you don’t know your local department call Housing and Urban development and ask for that information.

    They can do anything they want when a tennant doesn’t sign a lease. Next time only move to places that have leases.
